Abu Qatada Freed After Winning Appeal

Terror suspect Abu Qatada has been released on bail after winning his latest appeal to avoid extradition to Jordan.

The radical cleric smiled as he was driven from Long Lartin prison in Worcestershire and returned to his family home in north west London.

He was taken from the maximum security jail in a black Volkswagen people carrier and made no attempt to hide from photographers.

Protesters gathered outside his house shouted "out, out, out" when he arrived later and was escorted inside by officials.

Resident Jackie Chaunt, 50, said: "He shouldn't be here. It's a disgrace." Aaron Baker added: "We're paying for all this as taxpayers. It's ridiculous."

Justice Secretary Chris Grayling said in the Commons that the case shows why the Human Rights Act needs overhauling.

"All of us believe the law should not operate in this way and this case underlines my view that there is a very real need to major changes to the way the European human rights framework operates," he said.

Qatada was granted bail on Monday after judges ruled returning him to his home country to face trial would breach his human rights.

Home Secretary Theresa May had obtained assurances from Jordan that evidence obtained through torture would not be used at his trial.

But in a serious blow, the Special Immigration Appeals Commission (Siac) said this could still not be guaranteed and refused to back the Government.

The decision is the latest twist in an 11-year legal battle, that is believed to have cost the British taxpayer at least £1m.

Qatada, once described as Osama bin Laden's right-hand man in Europe, will have to obey a 16-hour curfew and can only go out between 8am and 4pm.

He will also have to wear an electronic tag, cannot use the internet and will be barred from contacting certain people - who cannot be named for legal reasons.

Round-the-clock surveillance of his home is now expected to be put in place, at a reported cost of up to £100,000 a week.

Downing Street has said the Home Office will be ensuring "we take all the necessary steps" to make sure Qatada does not pose a risk to national security".

Qatada was granted leave to remain in Britain in 1994 after arriving here and seeking asylum but he was convicted of terror charges in Jordan in his absence in 1999.

Since 2001, Britain has been trying to deport him to his home country so that he can be retried but every attempt has been thwarted.

In April, he was rearrested and Mrs May declared he would soon be on a plane - but yet again, he managed to appeal.

The Home Secretary insists he is still "a dangerous man" and the Government is appealing the latest court ruling on the basis that Siac applied the wrong legal test.

"We believe that we have got the right assurances from the Jordanian government," the Prime Minister's spokesman said.

Deputy Prime Minister Nick Clegg added: "We are absolutely determined to see this man get on a plane and go back to Jordan. He does not belong here.

"He wanted to inflict harm on our country and this coalition Government is going to do everything we can to challenge this every step of the way to make sure that he is deported."

what do you think?

100k a week for surveillance? who are they using-Robbie Williams? Aren't we, as a country, breaking the law by harbouring a convicted criminal. Just pop him on a plane and to hell with it. When he's gone he's gone so what.

He looks in fine health to me, wasn't this the same man whom is life hating money grabbing legal team said he was to ill and weak to travel, disgusting. What should have happened was put him and his life hating followers on a clapped out plane on auto pilot and blew it out of the sky over the Atlantic, blame it on austerity cut backs. Setting this twisted life hater free has sent out a message to other terrorists that you can kill, plan and spread twisted views and be untouchable, get benefits paid , security paid. This is pushing the normally balanced people of this country to the bnp and vigilanty groups, which thousands of brave men and women fought against and sacrificed their lives in ww2, it smacks in the face of serving men and women killed or maimed in afganistan.. I've heard the phrase keep your friends close and your enemies closer but this beggars belief. Lastly evil shall prevail when good men do nothing

It is time to take a leaf out of the Italians handbook, if you play by the rules then you will be treated fairly, if you do not then you will be deported and no excuses will be accepted. The English Court's judges said Qatada could not hope to receive a fair trial if deported because it would likely be based on evidence obtained by torture. This isn't a fact but it does show how perverted justice has become, judgment must be based solely on evidence, not subjective opinion which has no basis in fact. Clairvoyance has no legal basis in law.

Wouldn't it be an awful shame if there was a mix up with the taxi driver and he ended up on a plane to Jordan? Yes, yes sir, we'll this plane will take you to your new home in Northern Ireland...nothing to worry about. Oops it seems we put you on the wrong plane and you've ended up in Jordan - of all places!

He earns £2000 amonth in benefits plus we pay his QC and his house rent and the police who defend him . The Judge and his QC should now be taken to court and charged with assisting a terror man and be put in prison for life and that man must now be sent back to Jordan with his entire family. The ECHR says he must go back.

Dont the people who have been on the end of his terror have human rights too? They should appeal to our courts that their human rights have been abused by this man/animal and they have the right to see him on trial in Jordan. The only reason he & his family are here is so he can avoid justice.

Why is it Britain treats terrorists better than its own citizens? they have the best houses and ample benefits and they are free to preach hatred, and once they've been through the prison system are more often than not allowed to stay. This is not what governments are elected for.Why is Britain known as the terrorist capital of the world?

The past "successes" of this suspected terrorists' barrister will ensure he (the barrister) goes down in history as the legal "genius" who has contributed most to terrorism in the 21st century. For this accolade he has been well paid from the public purse. Of course the misguided academic "experts" can take their share of the blame in keeping potential terrorists ,hate-mongers,gangsters and child molesters on the streets of Britain.
