Railway Guard Jailed Over Teen's Death

Railway guard Christopher McGee has been jailed for five years over the death of teenager Georgia Varley.

The 45-year-old was convicted of the manslaughter of the drunk teenager after he signalled for a train to move as she was leaning against the carriage.

He was found guilty of manslaughter by gross negligence by a unanimous jury at Liverpool Crown Court on Wednesday following a two-week trial.

College student Georgia, 16, had been on a night out in Liverpool with friends when she fell between the train and the platform at the city's James Street station in October last year.

She was three times the legal drink-driving limit and had 0.083mg of the drug mephedrone, or Mcat, in her system at the time, the court heard.

The prosecution said McGee, of Edenhurst Avenue, Wallasey, Wirral, was negligent because he gave the signal to the driver to start the train when Georgia was in contact with the train and was in an "intoxicated state".

McGee, who denied manslaughter, told the jury he thought Georgia was moving away from the train when he gave the signal to depart. He also said he did not know how drunk she was.

But Mr Justice Holroyde told McGee: "In my judgement, the CCTV footage is unequivocal, Georgia Varley was not moving away and she was not showing any sign of moving away.

"She only moved when the movement of the train deprived her of support and caused her to lose balance and fall to her death."

He added: "You did not intend to kill or even injure her, but you displayed an appalling disregard for her safety, and she paid for your criminal negligence with her life."

CCTV footage of the incident was shown to the jury during McGee's trial.

Georgia could be seen mistakenly getting off the train just before 11.30pm, and then turning around and leaning against the side as she realised her friends were still on board.

The Birkenhead Sixth Form College student was then seen to stagger and fall down the gap as the train moved off, before stopping after travelling around 30ft.

Seems very harsh. It would appear that no consideration has been given to the part the girl played in this sad tale of events.. If it has then this guy is lucky he hasn't been given a life sentence. And they call them JUDGES

justice is a joke, people are responsible for there own actions and should not blame the guard because this girl had got so bladdered she couldn't stand up

Miscarriage of justice . This was not manslaughter !!!! I do feel for Georgia and her family but this was a tragic set of circumstances that resulted in a very tragic end but pointing the finger won't bring her back!!! Sad tragic case :-(

Yet the judge makes no mention of her bearing any responsibility for the events of that night whatsoever. Welcome to the UK where no one accepts responsibility for their own actions and it is always someone elses fault. Even in the justice system apparently. Unbelievable

OMG why is this guy to blame. Sad as it is how can the parents blame the man for the daughters night out. If he were to have stepped in and try to assist her in anyway he may have got a load of abuse and verbal from them all. You have to ask why mum/dad were not aware how much the girl was drinking and taking drugs. It's always someone else to blame, late night staff either train drivers, cab drivers have to put up with all sorts of abuse when people are drunk at night and have a very difficult job. This will make it even more difficult as these people will think twice in assisting just in case they have to carry the can. Sad story :O(

A harsh stupid sentence the blame lay`s at her friends who should of looked after her , pretending to get off at the station and getting back on leaving Georgia there. A wake up call for all young drinkers who don`t do social drinking but go out to get drugged up and smashed.Two lives ruined Georgia and the Guard.

Well, I'm sorry, you lot, but I have to completely disagree with you! Of COURSE the man was not responsible for this poor girl's drunken/drugged condition (that is a whole different set of sad circumstances) ... be he WAS responsible for ensuring the safety of passengers and potential passengers on the platform. The girl was still leaning on the train when he gave the signal for it to move!!! What if it was someone who had fainted, was having a diabetic hypo, suffering from exhaustion, having a heart attack ... any other reason??? He shouldn't have given the signal if ANYONE was that close to the train! His blame is not about her drinking, it's about him not doing his job properly.

Yes I agree the Guard was guilty of not doing his job but 5 years is over the top he miss judged the situation like if you knock someone on a pedestrian crossing .The rail staff are regularly attacked by drunks and yobs .

5 years ouch!. What a nightmare. Probably a decent hardworking bloke sets off to work one evening and ends up getting 5 years whilst a young immature girl is necking vodka and drugs to have a "good" time and her mum (naturally) says she is such a wonderful person doing what most teenagers do. She may well be in a better bless where her life no longer needs drugs and alcohol and a mum who says its ok shes only doing what teenagers do. My lad went down that road and as much as I love him he was still being an irresponsible ****head. Sorry for being harsh

this is 1 big joke. the family of this man should start sueing every person from the parents for having the girl to who sold her drink and drugs. they must shoulder some of the blame if they jailed this guy ..and dont forget the judge and jury for being idiots

p.s the pubs and clubds where this girl was drinking must be punished too as at 16.the law states you cannot drink or did his lawyer just forget about this GOING TO SET UP A PAGE (FREE CHRISTOPHER) again british justice you could not write this
