Texas Father Charged As Killer Driver Shot
A father in Texas has been charged with murdering a drink-driver who ploughed into his sons.
The boys had been helping their 31-year-old dad, David Barajas, push the family's broken-down pick-up truck when Jose Banda's car rammed into them.
David Barajas Jr, 12, died at the scene. Caleb, 11, died later in hospital.
Neighbours said they heard shooting minutes after the December 7 crash on a quiet, rural road near Alvin, about 30 miles southeast of Houston.
Banda, 20, was later found with a bullet in his head.
Tests revealed he was intoxicated at the time of the crash.
Witnesses told police they saw the father walk to his home right after the collision and return a few minutes later.
"Every time we would pursue a lead, it always came back to Mr Barajas," said Brazoria County sheriff's investigator Dominick Sanders.
"We have numerous statements placing him there at the car in close proximity to the victim at the time the gun was fired."
Two months after the crash, the father was indicted for murder and turned himself in to police.
Mr Barajas' brother previously said his sibling remembered the crash as a "blur".
He dismissed speculation that a family member was responsible for the shooting as "ugly".
The boys' mother, Cindy Barajas. was in the truck when it was hit, along with the couple's 8-year-old daughter and 3-month-old son.
A search of the family home turned up ammunition matching the bullet used in the shooting, but no murder weapon.
Mr Barajas is being held in the Brazoria jail on a $450k (£288k) bond.
